Warranty & Consumer Rights
Your rights under South Africa's Consumer Protection Act, and our commitments on quality.
BodyHer products are covered by the implied warranties set out in the Consumer Protection Act 68 of 2008 (CPA) and the Electronic Communications and Transactions Act 25 of 2002 (ECTA). This page explains those rights and how we honour them.
1. Your statutory right to quality goods (CPA s. 55)
Every product we sell must:
- Be reasonably suitable for the purposes for which it is generally intended;
- Be of good quality, in good working order and free of defects;
- Be usable and durable for a reasonable period, considering normal use and the circumstances of supply; and
- Comply with any applicable standards under the Standards Act or any other public regulation.
2. Six-month implied warranty (CPA s. 56)
If, within six (6) months of delivery, a BodyHer product fails to meet the standards in section 1 above, you may return it — at our cost — and choose one of the following remedies:
- Repair or replacement of the failed, unsafe or defective goods; or
- A full refund of the price paid.
The choice of remedy is yours, subject to the CPA. Where a repair is elected and the same defect reoccurs within three (3) months of the repair, we will replace the item or refund you in full.
3. What is not a defect
The statutory warranty does not cover:
- Damage caused by misuse, accident, alteration, or failure to follow the care instructions on the garment label;
- Normal wear and tear, including loss of elasticity after extended use;
- Discolouration or damage caused by tumble-drying, bleaching, or ironing shapewear (all our shapewear is hand-wash cold only); or
- Damage caused by third-party laundry services.
4. How to claim under warranty
- Email info@bodyher.co within a reasonable time of discovering the defect, and in any event within the 6-month CPA window.
- Include your order number, a description of the fault, and clear photographs.
- We will respond within one business day with a prepaid return label or courier arrangement.
- Once received and inspected, we will confirm your chosen remedy (repair, replacement or refund) within 5–10 business days.
5. Right to safe, good-quality goods (CPA s. 61)
If any BodyHer product causes harm because of a product defect, hazard or inadequate instructions, please stop using it immediately and contact us. You have rights under section 61 of the CPA to claim from the producer, importer, distributor or retailer, without needing to prove negligence.
6. Cooling-off period (ECTA s. 44)
As this is an electronic transaction, you have a 7-day cooling-off right under section 44 of ECTA to cancel your order without reason and receive a refund of the purchase price, less the direct cost of returning the goods. This right is separate from, and additional to, your CPA warranty rights. See our Returns & Exchanges page for the hygiene conditions that apply to intimate apparel.
7. Nothing in this policy limits your CPA rights
To the extent that any term in our Terms of Service, Returns Policy or elsewhere on this site conflicts with the Consumer Protection Act, the CPA prevails. This warranty is in addition to, and does not replace, your statutory rights.
8. Dispute resolution
If we cannot resolve a warranty issue with you directly, you may refer the dispute to:
- The National Consumer Commission (NCC) — thencc.gov.za
- The Consumer Goods and Services Ombud (CGSO) — cgso.org.za
- A relevant Provincial Consumer Protector.
